THE ASSAM MEDICAL COUNCIL(AMENDMENT) ACT, 2014

ASSAM ACT NO.III OF 2014

    An Act further to amend the Assam Medical Council Act, 1999.

    Preamble:- Whereas it is expedient further to amend the Assam Medical Council Act, 1999, .hereinafter referred to as the principal Act, in the manner hereinafter appearing;

    It is hereby enacted in the Sixty-fifth Year of the Republic of India as follows ::-

1. Short title, extent and commencement:- (1) This Act may be called the Assam Medical Council (Amendment) Act, 2014.

(2) It shall have the like extent as the principal Act.

(3) It shall come into force at once.

2. Amendment of Section 3:- In the principal Act, in section 3,-

(i) in sub-section (1),-

(a) in clause (a), in the second line, the word "three" shall be deleted,

(b) in clause (b), for the words "concerned University of that College", the words "Srimanta Sankardeva University of Health Sciences" shall be substituted.

(c) for clause (d), the following shall be substituted, namely:-

"(d) three members who are Registered Medical Practitioners with the Council are to be nominated by the State Branch of the Indian Medical Association and out of them one member shall be woman."

(ii) sub-section (2) and (3) shall be deleted and the existing sub-sections (4), (5) and (6) shall be re-numbered respectively as sub-sections (2), (3) and (4)

(iii) in sub-section (4) as re-numbered under sub-clause (ii) above, after the word "Council" appearing at the end, the words "subject to maintaining a quorum of 2/3rd members in the meeting" shall be inserted.

3. Amendment of section 5:- In the principal Act, in section 5, the words and punctuation marks "or elect, as the case may be," shall be deleted.

4. Amendment of section 7:- In the principal Act, 10 section 7, the words "elected or" shall be deleted.

5. Amendment of section 8:- In the principal Act, in section 8,-

(i) in sub-section (2), the words "or election" shall be deleted.

(ii) in sub-section (3), the words "or re-election" shall be deleted.

6. Amendment of section 9:- In the principal Act, in section 9, in sub -section (J), for the words "An elected or nominated", the word "A" shall be substituted.

7. Amendment of section 10:- In the principal Act, in section 10,-

(i) in sub-section ( 1), for the words and punctu at ion marks "or election, as the case may be," shall be deleted.

(ii) in sub-sectio n (2), the words "or elected" shall be del eted .

8. Amendment of section 11:- In the principal Act , in section 11, in sub-section (2), in between the words " absence" and "any" appearing in the first line , the words "Vice .President and in absence of both " shall be inserted.

9. Amendment of section 13:- "In the principal Act, in section 13, in sub-section (1), for the word "Treasury" appearing at the end, the word "Treasurer" shall. be substituted.

10. Insertion of new sections 32A, 32B, 32C and 32D:- In the principal Act, after section 32, the following new sections 32A , 32B, 32C and 320 shall be inserted, namely :-

32A."Temporary Registration! permission to foreign Doctors:- In case, a non-Indian doctor/ medical practitioner with foreign medical degree, intends to participate in any training programme or conference or any such other programmes to offer health care service including consultation and surgery to patient, such doctor shall have to apply in writing to the Council with pa yment of such fees as may be prescribed and revised by the Council from time to time and , the Council, through an expert committee to be con stituted by its President, upon scrutiny of the credentials of the applicant, and on being satisfied about the same, sha ll issue a temporary registration certificate allowing himlher to parti cipate in such programme for a specified period.

32 B. Renewal of Registration:-Every registered medical practitioner under the Council shall have to renew his Registration at every 5(five) years interval with his updated academic and professional credentials and such renewal shall be granted upon payment of such renewal fees as may be prescribed and revised by the Council from time to time

32 C. Grant of Academic Credit Point:- The Council shall award academic credit point to registered medical practitioners for scientific Continuous Medical Education (CME)/ Conference as per guidelines framed by the Medical Council ofIndia from time to time.

32 D. Ethical Committee:- Ethical Committee shall be Constituted by three (3) Members of the Council and they shall be elected by the members of the Council and this Ethical Committee shall function as per guidelines laid down by the Medical Council of India from time to time. If any doctor is found guilty of violation of ethic s by the Ethical Commi ttee, his/her Registration may be withdrawn for a period of time as may be decid ed by the Ethical Committee."
