CAPTAIN WILLIAMSON SANGMA TECHNICAL UNIVERSITY ACT, 2011

ACT NO. 17 OF 2011

    An Act, to establish and incorporate a University in the State, with emphasis on providing high quality and industry relevant education in the areas of engineering, physical sciences, life sciences, technology, including technical, and related areas sponsored by the State Government through regular and distance education mode and to provide for matters connected therewith or incidental thereto.

Be it enacted by the Legislature of the State of Meghalaya in the Sixty-second Year of the Republic of India as follows:

CHAPTER 1

PRELIMINARY

1. Short title and commencement:- (1) This Act may be called Captain Williamson Sangma Technical University Act, 2011.

(2) It shall come into force on such date as the State Government may, by notification appoint.

2. Definitions:- In this Act, unless the context otherwise indicates:

(i) “Academic Council” means the Academic Council of the University;

(ii) “Act” means the Captain Williamson Sangma Technical University Act, 2011;

(iii) “affiliated college” means a college or institution affiliated with the University;

(iv) “AICTE” means the All India Council for Technical Education established under Section 3 of the All India Council for Technical Education Act, 1987;

(v) “Annual Report” means the annual report of the university as prepared in Section 44 of the Act;

(vi) “Board of Governors” means the board of governors of the University as referred to in Section 21 of the Act;

(vii) “Board of Management” means the Board of Management of the University constituted in Section 22 of the Act;

(viii) “Society” means a society to be registered under the “Societies Act”.

(ix) “Chancellor” means Chancellor of the University appointed under Section 14 of the Act;

(x) “Constituent College” means a college or an Institution established and maintained by the university;

(xi) “DEC” means the Distance Education Council;

(xii) “Development Fund” means the Development Fund of the University established under Section 43 of the Act;

(xiii) “Distance Education System” means the system of imparting education through all mode of education such as Information Technology, Communication and other media such as Multimedia, Broadcasting, Telecasting, Online over internet, portal, other interactive methods, email, internet, computer, interactive talk-back, elearning, correspondence course, seminar, contact programme or a combination of any two or more of such means, through any mode of technology assisted learning for academics, research and training in any field under blended learning pattern etc.;

(xiv) “Employee” means employee appointed by the university and includes teachers and other staff of the university or of a constituent college;

(xv) “Faculty” means Faculty of the University;

(xvi) “Finance Officer” means Finance Officer of the university appointed under Section 18 of the Act;

(xvii) “General Fund” means General fund of the University as referred to in Section 41 of the Act;

(xviii) “prescribed” means prescribed by the rules, regulations or statutes under the Act;

(xix) “Off-campus Centre” means a centre of the private university established by it outside the main campus (within or outside the state) operated and maintained as its constituent unit, having the university’s compliment of facilities, faculty and staff;

(xx) “Official Gazette” means the Gazette of Meghalaya;

(xxi) “Off-Shore Campus” means a campus of the private university established by it outside the country , operated and maintained as its constituent unit, having the university’s compliment of facilities, faculty and staff;

(xxii) “Principal” in relation to a constituent college, means the Head of the Constituent college and includes, where there is no Principal, the Vice principal or any other person for the time being appointed to act as Principal;

(xxiii) “Regional Centre” means a centre established or maintained by the University for the purpose of coordinating and supervising the work of Students and for rendering any other assistance including training, Conducting contact classes and administering examinations required by the students and for performing such other functions as may be conferred on such centre by the Board Of Management;

(xxiv) “Registrar” means Registrar of the University appointed under Section 17 of the Act;

(xxv) “Rules & Regulations” means the Rules & Regulations of the University;

(xxvi) “Sponsor” means State Government;

(xxvii) “State” means the State of Meghalaya;

(xxviii) “State Government” means the State Government of Meghalaya;

(xxix) “Statutes” means the Statutes of the University;

(xxx) “Study Centre” means a centre established and maintained by the university for the purpose of advising, counseling or for rendering any other assistance required by the students used in the context of distance education;

(xxxi) “Teacher” means a Professor, Associate Professor, Assistant Professor, and Lecturer or such other person as may be appointed for imparting education or conducting research in the university or in a constituent college or affiliated college or institution and includes the principal of a constituent college or affiliated college or institution, in conformity with the norms prescribed by the UGC;

(xxxii) “UGC” means the University Grant Commission established under the University Grants Commission Act, 1956;

(xxxiii) “University” means Captain Williamson Sangma Technical University established under this Act;

(xxxiv) “Vice Chancellor” means Vice Chancellor of the University appointed under Section 15 of the Act; and

(xxxv) “Visitor” means the visitor of the university as referred to in Section 13.
