Delhi Commission For Safai Karamcharis Act, 2006
An Act to provide for the establishment and functioning of a Commission for Safai Karamchaxis to safeguard the rights and interests, and the redressal of the grievances of the Safai Karamcharis residing in the National Capital Territory of Delhi and for matters connected therewith or incidental thereto.
BE it enacted by the Legislative Assembly of the National Capital Ten-itory of Delhi in the Fiftyseventh Year of the Republic of India as follows:-
CHAPTER-1
PRELIMINARY
1. Short title, extent and commencement- (1) This Act may be called the Delhi Commission for Safai Karamcharis Act, 2006.
(2) It extends to the whole of the National Capital Territory of Delhi.
(3) It shall come jnto force on such date as the Government may, by notification in the official Gazette, appoint.
2. Definitions:- In this Act; unless the cotttext otherwise requires,-
(a) "Chairperson” means the Chairperson of the Delhi Commission for Safaj Karamcharis appointed under subsection (2) of section 3 of this Act:
(b) "Commission” means the Delhi Commission for Safai Karamchefis constituted under section 3 of this. Act;
(e) "Delhi" means the National Capital Territory of Delhi;
(d) "Government" means the Lieutenant Governor of the National Capital Territory of Delhi appointed by the President under article 239 and designated a: such under infielo 339M oftha Constitution;
(e) ”lieutenant Governor” means the- Lieutenant Governor of the National Capital Territory of Delhi appointed by the President under article 239 of the Constitution;
(f) "member” means a member of the Commission;
(g) ”prescribed" means prescribed by rules made under this Act;
(h) ”Safai Karamchari" means a person engaged in, or employed for, assisting in disposal of human excreta, or any sanitation work;
(i) ”National Commission” means the National Commission for Safai Karamcharis, constituted under the National Commission for Safa Karamcharis Act, 1993 (64 of 1993).
CHAPTER II
THE DELHI COMMISSION FOR SAFAI KARAMCHARIS
3. Constitution of the Commission..- (1) As soon as may be after the commencement of this Act, the Govermnent shall, by notification 'in the official Gazette, consfimte a body to be called the Delhi Commission for Safai Karamcharis to exercise the powers conferred on, and to perform the functions assigned to, it under this Act.
(2) The Commission shall consist of a Chairperson and two part—fime members to be nominated by the Government from amongst persons of eminence, ability and integrity frOm Safai Karamcharis of Delhi
