THE JHARKHAND STAFF SELECTION COMMISSION ACT, 2008

[JHARKHAND ACT 16, 2008]

AN ACT for the constitution of Jharkhand Staff Selection Commission (J.S.S.C.) for bringing uniformity in the process of selection of the technical and non-technical posts class III under the administrative control of the Government of Jharkhand.

Preamble As there has been a large scale increase in the number of candidates appearing for competitive examinations and the responsibilities of Jharkhand Public Service Commission have increased manifold Therefore it has been considered as expedient to constitute a separate Commission namely "Jharkhand Staff Selection Commission" to take over the responsibility or recruitment of group C posts under the State Government Corporations, Boards, Authorities and other Agencies of the State Government;

And, as the Fitment Committee in its report (Vol. IV, Book-2) under chapter-7, para-7-3- 1313 (d) has given its recommendation to consider the probability of constitution of a Commission like Staff Selection Commission,

And, as in these circumstances, it is appropriate to regulate an Act for the constitution of Jharkhand Staff Selection Commission to bring uniformity in the selection procedure for the appointment of eligible candidates to the posts of Class-3.

Now, therefore, be it enacted by the Legislature of the State of Jharkhand in the Fifty ninth year of the Republic of India as follows :-

1. Short title, extent and commencement. -(i) This Act may be called the Jharkhand Staff Selection Commission Act, 2008.

(ii) It extend to the entire State of Jharkhand.

(iii) It shall come into force immediately.

2. Definitions. - In this Act unless the context otherwise requires :-

(A) "Act" refers to the Jharkhand Staff Selection Commission Act, 2008.

(B) "State Government" means the Government of Jharkhand.

(D) "Chairman" means the Chairman of Jharkhand Staff Selection Commission

(E) "Member" means the member of Jharkhand Staff Selection Commission.

(F) "Rules" means the rules framed under this Act.

3. Constitution Of Commission. - The Jharkhand Staff Selection Commission shall be constituted as follows:-

(A) Chairman- An officer of the Indian Administrative Service, appointed by the State Government not below the rank of Super-time Scale with at least three years of service remaining.

(B) Member- Two officers of All India Services/State Services, appointed by the State Government not below the pay scale of Rs. 14300-18300 (or similar pay scale revised time to time) with at least three years of remaining.

(C) Appointment of Chairman/Members- The State Government shall be the appointing authority for the Chairman/Members.

4. Tenure Of Chairman & Members. - (i) The Tenure of Chairman & Members shall be of four years or till superannuation, whichever be earlier.

(ii) The Chairman or the Members can be removed from post on grounds of proven misconduct by the State Government provided that before removal, the Chairman/Members shall be given an opportunity of being heard.

5. Services/cadres/post For Which Commission May Recommend For The Appointment. - The Commission may recommend for the appointment of all General/Technical/Non Technical services/Cadres/Posts under the State Government for all groups 'C' posts or as may be determined by the State Government from time to time.

6. Sub-Ordinate Officers & Employees. - The Service Conditions of the subordinate officers and employees shall be such as will be determined by the State Government from time to time.

7. Headquarter of Commission 7 Administrative Deptt. - The headquarter of the Commission shall be at Ranchi. The Department of Personnel, Administrative Reforms & Rajbhasha shall be the administrative Department of the Commission.

8. Process Of Selection. - The Commission shall formulate the process of selection for different services/posts with the prior approval of the State Govt.

9. delegation of powers. - (i) As regards Administrative and Financial Powers, the Chairman of the Commission would exercise the powers of the Head of Department.

(ii) The Chairman of the Commission shall delegate the duties of examination controller to one of the members and the duties of Administrative matters to the other member.

10. Transfer Of Pending Selection Work With Respect To Class Three Posts. - All selection for recruitment to the posts as mentioned in section-5, for which the Jharkahnd Public Service Commission has not advertised till the enactment of this Act would be done by Jharkhand Staff Selection Commission. The Selection process of the posts which has been advertised by Jharkhand Public Service Commission will be completed by Jharkhand Public Service Commission.

11. Financial Provision. - All expenditure incurred in the functioning of the office of the commission shall be met by State Government. The Commission shall receive fees from the candidates for the examination/selection which has to be deposited in the State treasury.

12. Power To Formulate Rule. - (i) The State Government shall have the power to make Rules for the implementation of provisions of this Act.

(ii) The Commission shall have the powers to frame Regulations, with the approval of the State Government, for the conduct and other work of the advertisement, conduct of written examination, publication of examination results, personality Test/Interviews, if any.
