 Mysore State Civil Services (Recruitment of Local Candidates to Class III Posts) Rules, 1966

NOTIFICATION 

In exercise of the powers conferred by the proviso to Article 309 of the Constitution of India and  all other powers enabling him in this behalf, the Governor of Mysore hereby makes the following rules,  namely;- 

1. Title:- These rules may be called the Mysore State Civil Services (Recruitment of Local  Candidates to Class III Posts) Rules, 1966 

2. Definitions:- In these rules, unless the context otherwise requires,- 

(a) ‘appointing authority’ means the appointing authority as defined in clause (a) of rule 2 of the  Mysore Civil Services (Classification, Control and Appeal) Rules, 1957; 

(b) ‘Local Candidate’ means any person appointed to any of the categories of Class III Posts by an appointing authority by direct recruitment otherwise than in accordance with rule 4 of the Mysore State  Civil Services (General Recruitment) Rules, 1957, or the special rules of recruitment applicable to such category of Class III Posts, but does not include any person,- 

(i) Selected for any class III post by a state Level Recruitment committee or a Divisional Level  Recruitment Committee whose selection has been validated by the Mysore State Civil  Services Class III Posts Recruitment (Validation) Act, 1965 (Mysore Act 17 of 1965); or (ii) Selected by the Mysore Public Service Commission; or 

(iii) Appointed temporarily for a fixed period or for any item of work. 

(c) Other words and expressions used but not defined in these rules shall have the same meaning as in the Mysore State Civil Services (General Recruitment) Rules. 1957. 

3. Appointment of Local candidates as regular Candidates.- (1) Subject to the appointment of candidates selected by the Mysore Public Service Commission and of candidates whose selection has been validated by the Mysore State Civil Services Class III Posts Recruitment (Validation) Act, 1965  (Mysore Act 17 of 1965), direct recruitment to a Class III Posts in each Department shall,  notwithstanding anything contained in any rules of recruitment6 relating to recruitment to any of the categories of Class III posts issued under the proviso to Article 309 of the Constitution of India, be made by the appointing authority concerned, by appointing local candidates who were not disqualified for appointment under the Mysore State Civil Services (General Recruitment) Rules, 1957 on the date of their appointment as local candidates and who possess the qualifications specified in sub-rule (2).

(2) For purposes of sub-rule (1), the candidate must be a person,- 

(i) who had not attained thirty-three years of age in the case of person belonging to  any of the Scheduled Castes or Scheduled Tribes, and twenty-eight years of age  in the case of others; 

(ii) who possesses the minimum academic qualification prescribes for appointment  to the Class III post referred to in item (iii) by the special rules of recruitment  applicable for recruitment to such post as in force on the date on which such  person was appointed to such posts; 

(iii) who has been appointed on or before the 31st December 1964, as a local  candidate to a Class III Post and must be in the continuous service of the Service  Government immediately before the date of commencement of these rules; 

4. Manner of appointment;- (1) The appointment of candidates to each category of posts in a  Department shall be made by the appointment of person who possesses the qualifications specified in rule 3,  in the order of seniority of the local candidates, the order of seniority being determined on the basis of the  total length of continuous service put in by such local candidates in such category of posts in such 

Department. 

(2) If in any Department, appointment of a candidate under sub-rule (1) cannot be made owing to the non-availability of vacancies of the category to which the candidate is eligible for appointment under rule 3 such candidate may be appointed to a similar category of post in any other department and when so appointed, the provisions of these rules shall apply to such candidate as if such candidate were a person serving in that Department in that category of post as a local candidate and was appointed under sub-rule  (1). 

(3) The procedure to be followed for giving effect to sub-rules (1) and (2) shall be such as the  State Government may by general or special order direct. 

5 . Fixation of initial pay and reckoning of service for purposes of leave, increment etc.- Notwithstanding anything contained in the Mysore Civil Services rules and category of post in a  Department other than the Department in which he was serving immediately before the date of his appointment under rule 4,- 

(1) The initial basic pay of a candidate shall be so fixed in the scale of pay of the category of post  to which he is appointed under Rule 4 at such stage that it shall not be less than the basic pay that he was  eligible to draw in the scale of pay of the post held by him immediately before the date of his appointment  under Rule 4; and 

(2) The service rendered by a person as a local candidate until the date of his appointment under these rules shall count for purposes of leave, increment, and pension in the same manner and to the same extend and subject to the same conditions applicable to a temporary Government servant. 

6. Service for purpose of seniority;- The service rendered by a candidate on or after the date of his appointment to any category of post in a Department under Rule 4 shall count for purpose of determination of seniority of such person with reference to persons who are appointed to such category of posts in such Department.

7. Application of other rules.- (1) Save as otherwise provided in these rules, the provisions of the rules of recruitment specially made and applicable to any service or post relating to recruitment to the cadres of any of the categories of Class III posts shall apply to a person appointed under Rule 4. 

(3)The Mysore State Civil Services (General Recruitment) Rules, 1957, the Mysore Civil services Rules, the Mysore Civil Services (Conduct) Rules, 1966, and all other rules for the time being in force regulating the conditions of service of Government servants made under the proviso to Article 309  of the Constitution of India, in so far as such rules are not inconsistent with the provisions of these rules,  shall be applicable to persons appointed under these rules.
