THE PUNJAB PLASTIC CARRY BAGS (MANUFACTURE, USAGE AND DISPOSAL) CONTROL (AMENDMENT) ACT, 2016

(Punjab Act No 21 of 2016)

    An act further to amend the Punjab Plastic Carry Bags (Manufacture, Usage and Disposal) Control Act, 2005.

    Be it enacted by the Legislature of the State of Punjab in the SixtySeventh Year of the Republic of India, as follows:-

1. Short title and commencement:- (1) This Act may becalled the Punjab Plastic Carry Bags (Manufacture, Usage andDispasal) Control (Amendment) Act 2016.

(2) It shall be deemed to have come into force onand witheffect from the Ist day of February 2016.

2. Amendhient of section 7of PunjabAct 17 of 2005:- in the Punjab Plastic Carry Bags (Manufacture, Usage and Disposal) Control Act, 2005, the provision of section 7 shait be numbered as subsection (I) and after subsection (1) so renumbered, the following subsection shall beadded, namely

(2) Notwithstanding anything contained in sections 3,4, 5 and subsection (1) of section 7, the State Government, may by notification inthe Official Gazette, completely prohibit to manufacture, stock, distribute, recycle, sale or use of plastic carry bags and containers made of virgin or recycled plastic and plastic items having one time use such as disposable plastic cups, ttimblers, spoons, forks and straws"

3. Repeal and Saving:- (1) The Pinjab Plastic Carty Bags (Manufacture, Usage and Disposal) Control (Amendment) Ordinance, 2016 (Punjab Ordinance No 1 of 2016), is hereby repealed,

(2) Notwithstanding under the Ordinance such repeal, anything done or any action takén referred to in subsection been done or taken (1), shall be deemed to have” under the corresponding provisions of this Act
