THE RAJASTHAN PRIVATE UNIVERSITIES’ LAWS (AMENDMENT) BILL, 2018

(To be Introduced in the Rajasthan Legislative Assembly)

A Bill

further to amend the Private Universities’ Laws.

Be it enacted by the Rajasthan State Legislature in the Sixty-ninth Year of the Republic of India, as follows:-

1. Short title and commencement.- (1) This Act may be called the Rajasthan Private Universities’ Laws (Amendment) Act, 2018.

(2) It shall come into force at once.

2. Definitions.- In this Act, unless the context otherwise requires,-

a. “Private University Law” means a Private University Act specified in the Schedule; and

b. “Schedule” means the Schedule to this Act.

3. Amendment of section 13 of Private Universities’ Laws.- For the existing section 13 of the Private Universities’ Laws, the following shall be substituted, namely:-

“13. The President.- (1) The President shall be appointed by the Chairperson from a panel of not less than three and not more than five persons recommended by the Board of Management.

(2) No person shall be eligible to appoint as President unless he is a distinguished academician having a minimum of ten years experience as Professor in a university or college or ten years of experience in an equivalent position in a reputed research and/or academic administrative organization.

(3) The term of the office of the President shall be three years from the date on which he enters upon his office or until he attains the age of seventy years, whichever is earlier: Provided that the same person shall be eligible for reappointment: Provided further that a President shall, notwithstanding the expiration of his term, continue to hold office until his successor enters upon the office.

(4) For the purpose of selection of the President, the Board of Management shall invite applications from eligible persons through a public notice and while considering the names of persons to be appointed as President, the Board of Management shall give proper weightage to academic excellence, exposure to the higher education system in the country and adequate experience in academic and administrative governance and record its findings in writing and enclose the same with the panel to be submitted to the Chairperson.

(5) Any vacancy in the office of President shall be filled within six months from the date of such vacancy.

(6) The President shall be the principal executive and academic officer of the University and shall exercise general superintendence and control over the affairs of the University and shall execute the decisions of the authorities of the University.

(7) The President shall preside at the convocation of the University in the absence of the Chairperson.
