37. अस्थायी और शाश्वत व्यादेश -

(1) अस्थायी व्यादेश ऐसे होते हैं जिन्हें विनिर्दिष्ट समय तक या न्यायालय के अतिरिक्त आदेश तक बने रहना है तथा वे वाद के किसी भी प्रक्रम में अनुदत्त किए जा सकेंगे और सिविल प्रक्रिया संहिता, 1908 (1908 का 5) द्वारा विनियमित होते हैं ।

(2) शाश्वत व्यादेश वाद की सुनवाई पर और उसके गुणागुण के आधार पर की गई डिक्री द्वारा ही अनुदत्त किया जा सकता है ; तद्द्वारा प्रतिवादी किसी अधिकार का ऐसा प्रात्याख्यान या कोई ऐसा कार्य जो वादी के अधिकारों के प्रतिकूल हो, न करने के लिए शाश्वत काल के लिए व्यादिष्ट कर दिया जाता है ।

37. Temporary and perpetual injunctions.-

(1) Temporary injunctions are such as are to continue until a specified time, or until the further order of the court, and they may be granted at any stage of a suit, and are regulated by the Code of Civil Procedure, 1908 (5 of 1908).

(2) A perpetual injunction can only be granted by the decree made at the hearing and upon the merits of the suit; the defendant is thereby perpetually enjoined from the assertion of a right, or from the commission of an act, which would be contrary to the rights of the plaintiff.
