11. विधिमान्य दत्तक की अन्य शर्ते -- हर दत्तक में निम्नलिखित शर्ते पूरी की जानी होंगी :

(i) यदि पुत्र का दत्तक है तो दत्तक लेने वाले पिता या माता की, जिनके द्वारा दत्तक लिया जाए, कोई हिन्दू पुत्र, पुत्र का पुत्र या पुत्र के पुत्र का पुत्र (चाहे धर्मज रक्त नातेदारी से हो या दत्तक से) दत्तक के समय जीवित न हो;

(ii) यदि पुत्री का दत्तक है तो दत्तक लेने वाले पिता या माता की, जिनके द्वारा दत्तक लिया जाए, कोई हिन्दू पुत्री या पुत्र की पुत्री (चाहे धर्मज रक्त नातेदारी से हो या दत्तक से) दत्तक के समय जीवित न हो;

(iii) यदि दत्तक किसी पुरुष द्वारा लिया जाना है और दत्तक में लिया जाने वाला व्यक्ति नारी है तो दत्तक पिता दत्तक लिए जाने वाले व्यक्ति से आयु में कम से कम इक्कीस वर्ष बढ़ा हो;

(iv) यदि दत्तक किसी नारी द्वारा लिया जाना है और दत्तक लिया जाने वाला व्यक्ति पुरुष है तो दत्तक माता दत्तक लिए जाने वाले व्यक्ति से आयु में कम से कम इक्कीस वर्ष बढी हो ।

(v) वही अपत्य एक साथ दो या दो से अधिक व्यक्तियों द्वारा दत्तक नहीं लिया जा सकेगा;

(vi) दत्तक लिया जाने वाला अपत्य सम्पृक्त जनकों या संरक्षक द्वारा या उसके प्राधिकार के अधीन उस अपत्य के कुटुम्ब से जहाँ वह जन्मा हो अथवा परित्यक्त अपत्य की दशा में या ऐसे अपत्य की दशा में जिसकी जनकता ज्ञात न हो, उस स्थान या कुटुम्ब से जहाँ वह पला हो उसका दत्तक लेने वाले कुटुम्ब में उसे अन्तरित करने के आशय से वस्तुतः दिया और लिया जाएगा:

परन्तु दत्त होमम् का किया जाना किसी दत्तक की विधिमान्यता के लिए आवश्यक नहीं होगा।

 

11. Other conditions for a valid adoption - In every adoption, the following conditions must be complied with:

(i) if any adoption is of a son, the adoptive father or mother by whom the adoption is made must not have a Hindu son, son's son or son's son's son (whether by legitimate blood relationship or by adoption) living at the time of adoption;

(ii) if the adoption is of a daughter the adoptive father or mother by whom the adoption is made must not have a Hindu daughter or son's daughter (whether by legitimate blood relationship or by adoption) living at the time of adoption;

(iii) if the adoption is by a male and the person to be adopted is a female, the adoptive father is at least twenty-one years older than the person to be adopted;

(iv) if the adoption is by a female and the person to be adopted is a male, the adoptive mother is at least twenty-one years older than the person to be adopted;

(v) the same child may not be adopted simultaneously by two or more persons; (vi) the child to be adopted must be actually given and taken in adoption by the parents or guardian concerned or under their authority with intent to transfer the child from the family of its birth or in the case of an abandoned child or a child whose parentage is not known, from the place or family where it has been brought up to the family of its adoption.

Provided that the performance of datta homan, shall not be essential to the validity of an adoption.
