Learned counsel for the appellants prays for permission to
withdraw the appeal with liberty to again file a civil suit after
impleading proper parties.
The appeal is permitted to be withdrawn with liberty as aforesaid.
However, maintainability of the second suit shall be considered by
the Court below in accordance with law.
