Whereas the School of Planning and Architecture Act, 2014 (37 of 2014) (hereinafter referred to as the said Act) came into force on 22nd day of January, 2015; And, whereas, clause (a) of the section 27 of the said Act provides for the appointment of the Staff of every School by the Board, if the appointment is made on the academic staff in the post of Assistant Professor or if the appointment is made on the non-academic staff in every cadre the maximum of the pay scale of which exceeds prevalent grade pay scale for Group ’A’ Officers;

And, whereas, the following difficulty has arisen in giving effect to the provisions of clause (a) of section 27 that the provision for other posts i.e. Professors, Associate Professors etc. have not been included in the said section;

 And, whereas, further clause (c) of section 42 of the said Act provides that the Board of Governors, Finance Committee, Academic Council, Executive Council, Building and Works Committee and such other Committees of every School functioning as such immediately before the commencement of this Act shall continue to so function until a new Board is constituted for the School under this Act, but on the constitution of a new Board under this Act, the members of the Board of Governors, Finance Committee, Academic Council, Building and Works Committee and such other Committees holding office before such constitution shall cease to hold office;

And, whereas, the following difficulty has arisen in giving effect to the provisions of clause (c) of the section 42 that once a new Board is constituted for the School, the Finance Committee, Academic Council, Executive Council, Building and Works Committee and such other Committees of every School functioning as such immediately before the commencement of this Act become non-functional leading to the state of vacuum in the absence of these important Committees and moreover, the constitution of Finance Committee and Building and Works Committee has been envisaged under First Statute of the School of Planning and Architecture Act, 2014 which are under way and may take some more time in their finalisation. However, these Committees being important in discharging the day to day activities and for the better functional aspects at the School level, the functionality of these Committees is of high importance.

Now, therefore, in exercise of the powers conferred by sub-section (1) of section 40 of the said Act, the Central Government hereby makes the following Order to remove the aforesaid difficulties, namely:-
