युवा व्यक्तियों और कुछ अन्य व्यक्तियों द्वारा विस्फोटकों के विनिर्माण, कब्जे, विक्रय या परिवहन पर प्रतिषेध (Prohibition of manufacture, possession, sale or transport of explosives by young persons and certain other persons)

6 क. युवा व्यक्तियों और कुछ अन्य व्यक्तियों द्वारा विस्फोटकों के विनिर्माण, कब्जे, विक्रय या परिवहन पर प्रतिषेध -

इस अधिनियम के पूर्वगामी उपबन्धों में किसी बाते के होते हुए भी,

(क) कोई व्यक्ति,--

(i) जिसने अठारह वर्ष की आयु पूरी नहीं की है, या

(ii) जो किसी अपराध के लिए, जिसमें हिंसा या नैतिक अधमता अन्तर्ग्रस्त हो, दोषसिद्धि पर कम से कम छह मास की अवधि के लिए दण्डादिष्ट किया गया है, दण्डादेश की समाप्ति के पश्चात्‌ पांच वर्ष की अवधि के दौरान किसी भी समय, या

(iii) जिसे परिशान्ति कायम रखने और सदाचार के लिए दण्ड प्रक्रिया संहिता, 1973 (1974 का 2) के अध्याय 8 के अधीन बंधपत्र निष्पादित करने के लिए आदेश दिया गया है, बंधपत्र की अवधि के दौरान किसी भी समय, या

(iv) जिसकी अनुज्ञप्ति इस अधिनियम या इस अधिनियम के अधीन बनाए गए नियमों के उपबंधों के उल्लंघन के लिए, भारतीय विस्फोटक (संशोधन) अधिनियम, 1978 (1978 का 32) के प्रारम्भ के पूर्व या पश्चात्‌ इस अधिनियम के अधीन रद्द कर दी गई है, ऐसी अनुज्ञप्ति के रद्द किए जाने की तारीख से पांच वर्ष की अवधि के दौरान किसी भी समय,-

(1) किसी भी विस्फोटक का विनिर्माण, विक्रय, परिवहन, आयात या निर्यात नहीं करेगा, या

(2) किसी ऐसे विस्फोटक को कब्जे में नहीं रखेगा जिसे केन्द्रीय सरकार उसकी प्रकृति को ध्यान में रखते हुए शासकीय राजपत्र में अधिसूचना द्वारा विनिर्दिष्ट करे;

(ख) कोई व्यक्ति ऐसे किसी व्यक्ति को जिसके बारे में वह यह जानता है या उसके पास यह विश्वास करने का कारण है कि वह ऐसे विक्रय, परिदान या प्रेषण के समय -

(i) खण्ड (क) के अधीन ऐसे विस्फोटक का विनिर्माण, विक्रय, परिवहन, आयात, निर्यात करने या उसे कब्जे में रखने से प्रतिषिद्ध है, या

(ii) वह विकृतचित्त है, किसी विस्फोटक का विक्रय, परिदान या प्रेषण नहीं करेगा ।

6 A. Prohibition of manufacture, possession, sale or transport of explosives by young persons and certain other persons.—

Notwithstanding anything in the foregoing provisions of this Act,-

(a) no person,-

(i) who has not completed the age of eighteen years, or

(ii) who has been sentenced on conviction of any offence involving violence or moral turpitude for a term not less than six months, at any time during a period of five years after the expiration of the sentence, or

(iii) who has been ordered to execute under Chapter VIII of the Code of Criminal Procedure, 1973 (2 of 1974) a bond for keeping the peace or for good behaviour, at any time during the term of the bond., or

(iv) whose licence under this Act has been cancelled, whether before Or after the commencement of the Indian Explosives (Amendment) Act, 1978 (32 of 1978), for contravention of the provisions of this Act or of the rules made thereunder, at any time during a period of five years from the date of cancellation of such licence, shall,—

(1) manufacture, sell, .transport, import or export any explosive, or

(2) possess any such explosive as the Central Government may, having regard to the nature thereof, by notification in the Official Gazette, specify;

(b) no person shall sell, deliver or despatch any explosive to a person whom he knows or has reason to believe at the time of such sale, delivery or despatch,-

(i) to be prohibited under clause (a) to manufacture, sell, transport, import, export or possess such explosive, or

(ii) to be of unsound mind.
