376 घख बारह वर्ष से कम आयु की स्‍त्री से सामूहिक बलात्संग के लिए दंड

"जहां व्यक्तियों के समूह में से एक या अधिक व्यक्तियों दवारा सब के सामान्य आशय को अग्रसर करने में बारह वर्ष से कम आयु की किसी स्त्री से बलात्संग किया जाता है, वहां ऐसे व्यक्तियों में से हर व्यक्ति के बारे में यह समझा जाएगा कि उसने बलात्संग किया है और वह आजीवन कारावास से, जिसका अभिप्राय उस व्यक्ति के शेष प्राकृत जीवनकाल के लिए कारावास होगा और जुर्माने से अथवा मृत्यु से दंडित किया जाएगा :

परंतु ऐसा जुर्माना पीड़ित की चिकित्सा व्ययों और पुनर्वास की पूर्ति करने के लिए न्यायोचित और युक्‍क्तियुक्त होगा :

परंतु यह और कि इस उपधारा के अधीन अधिरोपित किसी भी जुर्माने का संदाय पीड़ित को किया जाएगा ।" [क्रिमिनल लॉ (संशोधन) अधिनियम, 2018, दिनांक – 11 अगस्त 2018 द्वारा अन्तः स्थापित] 

376 DB Punishment for gang rape on woman under twelve years of age

"Where a woman under twelve years of age is raped by one or more persons constituting a group or acting in furtherance of a common intention, each of those persons shall be deemed to have committed the offence of rape and shall be punished with imprisonment for life, which shall mean imprisonment for the remainder of that person's natural life, and with fine, or with death:

Provided that such fine shall be just and reasonable to meet the medical expenses and rehabilitation of the victim:

Provided further that any fine imposed under this section shall be paid to the victim." [Inserted vide - Criminal Law (Amendment) Act, 2018 Dated - 11 Aug, 2018].
