अध्याय 4 : साधारण अपवाद
76. विधि द्वारा आबद्ध या तथ्य की भूल के कारण अपने आपको विधि द्वारा आबद्ध होने का विश्वास करने वाले व्यक्ति द्वारा किया गया कार्य -
कोई बात अपराध नहीं है, जो किसी ऐसे व्यक्ति द्वारा की जाए जो उसे करने के लिए विधि द्वारा आबद्ध हो या जो तथ्य की भूल के कारण, न कि विधि की भूल के कारण, सद्भावपूर्वक विश्वास करता हो कि वह उसे करने के लिए विधि द्वारा आबद्ध है।
दृष्टांत -
(क) विधि के समादेशों के अनुवर्तन में अपने वरिष्ठ ऑफिसर के आदेश से एक सैनिक क भीड़ पर गोली चलाता है। क ने कोई अपराध नहीं किया।
(ख) न्यायालय का ऑफिसर, क, म को गिरफ्तार करने के लिए उस न्यायालय द्वारा आदिष्ट किए जाने पर और सम्यक् जांच के पश्चात् यह विश्वास करके कि य, म है, य को गिरफ्तार कर लेता है। क ने कोई अपराध नहीं किया।
CHAPTER 4: GENERAL EXCEPTIONS
76. Act done by a person bound, or by mistake of fact believing himself bound, by law -
Nothing is an offence which is done by a person who is, or who by reason of a mistake of fact and not by reason of a mistake of law in good faith believes himself to be, bound by law to do it.
Illustrations -
(a) A, a soldier, fires on a mob by the order of his superior officer, in conformity with the commands of the law. A has committed no offence.
(b) A, an officer of a Court of Justice, being ordered by that Court to arrest Y, and, after due enquiry, believing Z to be Y, arrests Z. A has committed no offence.
