धारा -140. हत्या करने के लिए या फिरौती, आदि के लिए व्यपहरण या अपहरण -
(1) जो कोई, इसलिए किसी व्यक्ति का व्यपहरण या अपहरण करता है कि ऐसे व्यक्ति की हत्या की जाए या उसको ऐसे व्ययनित किया जाए कि वह अपनी हत्या होने के खतरे में पड़ जाए, वह आजीवन कारावास से या कठिन कारावास से, जिसकी अवधि दस वर्ष तक की हो सकेगी, दण्डित किया जाएगा और जुर्माने का भी दायी होगा ।
दृष्टांत
(क) क इस आशय से या यह सम्भाव्य जानते हुए कि किसी देव मूर्ति पर य की बलि चढ़ाई जाए, भारत में से य का व्यपहरण करता है। क ने इस धारा में परिभाषित अपराध किया है।
(ख) ख को उसके घर से क इसलिए बलपूर्वक या बहकाकर ले जाता है कि ख की हत्या की जाए । क ने इस धारा में परिभाषित अपराध किया है ।
(2) जो कोई, इसलिए किसी व्यक्ति का व्यपहरण या अपहरण करता है या ऐसे व्यपहरण या अपहरण के पश्चात् ऐसे व्यक्ति को अवरोध में रखता है और ऐसे व्यक्ति की मृत्यु या उसकी उपहति कारित करने की धमकी देता है या अपने आचरण से ऐसी युक्तियुक्त आशंका पैदा करता है कि ऐसे व्यक्ति की हत्या या उपहति कारित की जा सकती है या ऐसे व्यक्ति को उपहति या उसकी मृत्यु कारित करता है जिससे कि सरकार या किसी विदेशी राज्य या अंतरराष्ट्रीय अंतर- शासनात्मक संगठन या किसी अन्य व्यक्ति को किसी कार्य को करने या करने से विरत रहने के लिए या फिरौती देने के लिए विवश किया जाए, वह मृत्यु या आजीवन कारावास से दंडित किया जाएगा और जुर्माने का भी दायी होगा ।
(3) जो कोई, इस आशय से किसी व्यक्ति का व्यपहरण या अपहरण करता है कि उसका गुप्त रूप से और सदोष परिरोध किया जाए, वह दोनों में से किसी भांति के कारावास से, जिसकी अवधि सात वर्ष तक की हो सकेगी, दण्डित किया जाएगा और जुर्माने का भी दायी होगा ।
(4) जो कोई, किसी व्यक्ति का व्यपहरण या अपहरण इसलिए करता है कि उसे घोर उपहति या दासत्व का या किसी व्यक्ति की प्रकृति विरुद्ध काम वासना का विषय बनाया जाए या बनाए जाने के खतरे में पड़ सकता है वैसे उसे व्ययनित किया जाए या सम्भाव्य जानते हुए करता है कि ऐसे व्यक्ति को उपर्युक्त बातों का विषय बनाया जाएगा या उपर्युक्त रूप से व्ययनित किया जाएगा, वह दोनों में से किसी भांति के कारावास से, जिसकी अवधि दस वर्ष तक की हो सकेगी, दण्डित किया जाएगा और जुर्माने का भी दायी होगा ।
Section 140. Kidnapping or abducting in order to murder or for ransom, etc.-
(1) Whoever kidnaps or abducts any person in order that such person may be murdered or may be so disposed of as to be put in danger of being murdered, shall be punished with imprisonment for life or rigorous imprisonment for a term which may extend to ten years, and shall also be liable to fine.
Illustrations.
(a) A kidnaps Z from India, intending or knowing it to be likely that Z may be sacrificed to an idol. A has committed the offence defined in this section.
(b) A forcibly carries or entices B away from his home in order that B may be murdered. A has committed the offence defined in this section.
(2) Whoever kidnaps or abducts any person or keeps a person in detention after such kidnapping or abduction, and threatens to cause death or hurt to such person, or by his conduct gives rise to a reasonable apprehension that such person may be put to death or hurt, or causes hurt or death to such person in order to compel the Government or any foreign State or international inter-governmental organisation or any other person to do or abstain from doing any act or to pay a ransom, shall be punishable with death, or imprisonment for life, and shall also be liable to fine..
(3) Whoever kidnaps or abducts any person with intent to cause that person to be secretly and wrongfully confined, shall be punished with imprisonment of either description for a term which may extend to seven years, and shall also be liable to fine..
(4) Whoever kidnaps or abducts any person in order that such person may be subjected, or may be so disposed of as to be put in danger of being subjected to grievous hurt, or slavery, or to the unnatural lust of any person, or knowing it to be likely that such person will be so subjected or disposed of, shall be punished with imprisonment of either description for a term which may extend to ten years, and shall also be liable to fine.
