Minor Minerals Rules 1996 amended

A cabinet meeting chaired by Chief Minister Shri Shivraj Singh Chouhan here today decided to amend Madhya Pradesh Minor Minerals Rules 1996.
Through the amendment, provision has been made to identify mines of stone, sand and flooring slab stones in every Panchayat so that villages can get free minor minerals for construction of their houses. Villages and farmers can get minerals from these identified mines. Process for environmental clearance of these mines will be taken up by concerning Janpad Panchayat.
Provision has been made to calculate duration for auctioned mines for 5 financial years from the date of disposal agreement. It has been provided to upwardly revise contract amount of sand, stone and mines of slab stones on private land by 5 percent every year. If crasher is established on the basis of kind of stone received from auctioned mine, the duration of contract will be of 10 years. Similarly, if cutting-polishing unit is set up at mine of flooring stone slab then duration of contract will be of 15 years.
Provision for renewal of mining lease on previously sanctioned stone slab mines on government land has been abolished. These mines will be allotted only through auction. Provision has been made to e-auction mines of stone slabs, stone and sand on government land. Time of 3 months will be given after auction for environmental clearance and completing other formalities. Extra 3 months time will be given in case agreement is not implemented after three months. If agreement is not implemented even during this period then security amount will be refunded after deduction of 10 percent.
Power to give sanction for muram mining was already vested in executive engineers of construction departments. Following amendment, power to sanction mining of clay for construction works have also been given to executive engineers.
A provision has been made to allow transportation of mined minor minerals for construction of reservoirs, dams etc. after receipt of market price of them. Price will have to be paid against minerals mined from government land. This price will be equal to double of royalty. Price equal to royalty will have to be paid for minerals mined from mines on private land.
A provision has been made to deposit 10 percent security amount before auction of minor minerals. Estimated security deposit of 25 percent will be realised following auction of mine. The 10 percent security deposit unsuccessful bidders will be refunded soon after auction.
As per the amendment, annual mining as per mining plan has been made mandatory.
3 medical colleges
The cabinet decided to establish medical colleges in Vidisha, Ratlam and Shahdol districts under PPP mode through annuity system. Shahdol medical college will have 100 MBBS seats along with a 500-bed hospital. Ratlam and Vidisha colleges will have 150 MBBS seats and 750-bed hospital each.
Airstrips
The cabinet accorded sanction for 15-year development agreements for 20 government airstrips at Neemuch, Ratlam, Khargone, Khandwa, Shivpuri, Guna, Tekanpur, Sagar (Dhana), Satna, Sidhi, Rewa, Chhindwara, Ujjain (Datana), Jhabua, Birwa (Jhabua), Pachmarhi, Umaria, Seoni, Mandla and Datia.
Special increment
The cabinet decided to sanction one special increment to officers of Madhya Pradesh cadre of All-India Services on standing first, second and third in national and international sports competitions.

मुख्यमंत्री श्री शिवराज सिंह चौहान की अध्यक्षता में आज सम्पन्न हुई मंत्रि-परिषद् की बैठक में मध्यप्रदेश गौण-खनिज नियम 1996 में संशोधन का निर्णय लिया गया।
संशोधन में ग्रामीणजन को स्वयं के भवन निर्माण के लिये नि:शुल्क गौण-खनिज प्राप्त हो सके, इसके लिये प्रत्येक पंचायत में पत्थर, मुरम तथा फर्शी पत्थर की उपलब्धता के अनुसार खादान चिन्हित किये जाने का प्रावधान किया गया है। चिन्हित खदानों से ग्रामीणजन तथा कृषक खनिज प्राप्त कर सकेंगे। इन खदानों की पर्यावरण स्वीकृति के लिये आवश्यक कार्यवाही ग्राम पंचायत से संबंधित जनपद पंचायत करेगी।
नीलाम खदानों की अवधि की गणना अनुबंध निष्पादन के दिनांक से पाँचवें वित्तीय वर्ष तक करने का प्रावधान किया गया है। रेत, पत्थर तथा निजी भूमि पर स्थित फर्शी पत्थर का नीलाम में प्राप्त ठेका धन प्रत्येक वर्ष 5 प्रतिशत बढ़ाने का प्रावधान किया गया है। नीलाम में प्राप्त पत्थर खदान के आधार पर यदि क्रेशर स्थापित किया जाता है, तो ठेका अवधि दस वर्ष की होगी। इसी प्रकार नीलाम में प्राप्त फर्शी पत्थर खदान में कटिंग-पॉलिशिंग उद्योग स्थापित करने पर ठेका अवधि 5 वर्ष के स्थान पर 15 वर्ष होगी।
पूर्व से शासकीय भूमि पर स्वीकृत फर्शी पत्थर खदानों के उत्खनि-पट्टा के नवीनीकरण का प्रावधान समाप्त किया गया है। इन खनिजों की खदानें नीलामी के जरिये ही दी जायेंगी। शासकीय भूमि पर फर्शी पत्थर खदान, पत्थर खदान तथा रेत खनिज की खदानों को ई-नीलामी के माध्यम से आवंटित करने का प्रावधान किया गया है। आवश्यक पर्यावरण अनुमति एवं अन्य आवश्यक औपचारिकता पूर्ण करने के लिये नीलामी के बाद तीन माह का समय दिया जायेगा। किसी प्रकरण में नीलामी के बाद तीन माह में अनुबंध निष्पादन नहीं करने पर अतिरिक्त तीन माह की अवधि दी जायेगी। यदि इस अवधि में अनुबंध निष्पादन नहीं किया जाता तब सुरक्षा राशि में से दस प्रतिशत कटौती के बाद शेष राशि वापस की जायेगी।
मुरम खनिज के उत्खनन की स्वीकृति की अधिकारिता निर्माण विभाग के कार्यपालन यंत्रियों को पूर्व से थी। संशोधन के बाद निर्माण कार्य के लिये उपयोगी मिट्टी खनिज की उत्खनन अनुज्ञा स्वीकृत करने का अधिकार कार्यपालन यंत्री को दिया गया है।
तालाब, बाँध एवं अन्य निर्माण कार्यों से निकलने वाले गौण-खनिज का बाजार मूल्य प्राप्त होने के बाद परिवहन की अनुमति दिये जाने का प्रावधान किया गया है। शासकीय भूमि से इस प्रकार निकाले गये खनिज पर उसका मूल्य जमा करना होगा। यह मूल्य रायल्टी के दोगुने के बराबर होगा। निजी भूमि से निकाले गये खनिज के परिवहन में खनिज का मूल्य रायल्टी के बराबर जमा करना होगा।
गौण-खनिज की नीलामी के पूर्व दस प्रतिशत सुरक्षा राशि लिये जाने का प्रावधान किया गया है। नीलामी के बाद खदान संचालन के लिये स्वीकृत बोली की 25 प्रतिशत की राशि अमानत राशि के रूप में ली जायेगी। नीलामी प्रक्रिया में भाग लेने वाले सफल बोलीदार को छोड़कर शेष बोलीदारों की दस प्रतिशत तत्काल वापिस की जायेगी।
किये गये संशोधन से खनन योजना के अनुरूप वार्षिक खनन किया जाना अनिवार्य किया गया।
तीन मेडिकल कॉलेज
मंत्रि-परिषद् ने विदिशा, रतलाम और शहडोल जिले में पीपीपी के आधार पर एन्युटी पद्धति से एक-एक मेडिकल कॉलेज की स्थापना का निर्णय लिया। शहडोल मेडिकल कॉलेज में एमबीबीएस की 100 सीट होंगी और इसमें 500 बिस्तर का अस्पताल निर्मित किया जायेगा। रतलाम और विदिशा मेडिकल कॉलेज में एमबीबीएस 150-150 सीट और 750-750 बिस्तर का अस्पताल होगा।
हवाई पट्टी
मंत्रि-परिषद् ने 20 शासकीय हवाई पट्टी को विमानन विकास गतिविधियों के लिये 15 वर्ष की अवधि के लिये डेव्हलपमेंट एग्रीमेंट को मंजूरी दी। यह हवाई पट्टियाँ नीमच, रतलाम, खरगोन, खण्डवा, शिवपुरी, गुना, टेकनपुर, सागर (ढाणा), सतना, सीधी, रीवा, छिंदवाड़ा, उज्जैन (दताना), झाबुआ, बिरवा (बालाघाट), पचमढ़ी, उमरिया, सिवनी, मण्डला और दतिया में हैं।
विशेष वेतन वृद्धि
मंत्रि-परिषद् ने मध्यप्रदेश संवर्ग के अखिल भारतीय सेवा अधिकारियों द्वारा राष्ट्रीय एवं अंतर्राष्ट्रीय खेल स्पर्धा में प्रथम/द्वितीय एवं तृतीय स्थान प्राप्त करने पर उन्हें एक विशेष वेतन वृद्धि स्वीकृत करने का निर्णय लिया।
